MINUTES: Meeting of Tuesday, September 15, 2009
CALL TO ORDER at 7:30 PM by Chairman Tom McElroy
ROLL CALL: Chairman Tom McElroy, Vice-Chairman Alan French,
Jack Kozec, Alternate: Charles Melvin, Sr.
bsent: Dana Allison, Brad Cardoso and Alternate Ken Pelletier.
Guests: Ronald Pica, Applicant, Robert Peterson, Robert Johnson, Gene Tolman, Augustine Medeiros, residents of Wenmark Road…
Mr. Melvin was made a voting member.
ACCEPTANCE OF MINUTES: Meeting of August 18, 2009. A motion was made by Mr. Kozec to accept the minutes as written. Second by Mr. Melvin. Motion carries.
NEW BUSINESS:
A. Motion for ReHearing from Attorney Ryan:
Re: Ronald Pica, Sara Realty LLC, Whispering Pines Campground,
8 Wenmark Road, Newton, NH 03858 (Map #05-001-05) seeking a variance in order to create
additional sites to the campground.
When asked to speak, Mr. Pica replies that he is seeking a rehearing on the 2 issues of the Variance Criteria: #2. Spirit of the Ordinance, and #5. Substantial Justice.
The Applicant had come before the Board for a variance earlier this year. His request was denied at the March 17, 2009 meeting, and also at the August 18, 2009 meeting.
The concern of the Applicant is that the Board's vote on August 18 was not the same as the vote taken on March 17. The Applicant (& his attorney) wish to know why the contrary votes.
The Board explained that there were different Board members voting at each meeting.
On March 17, Mr. Allison, Mr. Melvin, and Mr. Pelletier were absent. The 4 voting members were Chairman McElroy, Vice-Chairman French, Mr. Cardoso, and Mr. Kozec. At the August meeting, the voting members were Chairman McElroy, Mr. Allison, Mr. Cardoso, Mr. Kozec, and Mr. Melvin.
Mr. Kozec made a mmotion to deny another rehearing. Second by Mr. Melvin. No discussion. Vote: 3 in favor of the motion, and 1 abstention (Mr. French was absent last month).
Mr. Peterson said he would also be filing for rehearing.
OLD BUSINESS:
A. Discussion of the salary of the Police Officer used at the August meeting.
B. Discussion of the upcoming conferences of the New Hampshire Municipal Association. Mrs. Clark had been unable to register the 3 members interested, and the Board members had had no success either.
C. Discussion of the Budget expenditures through August 31, 2009.
D. Memo regarding the September 21 Department Head Meeting.
E. Memo from the Recreation Commission regarding the Newton Fall Fair.
ADJOURNMENT: A motion was made at 7:45 PM by Mr. Kozec to adjourn. Second by Mr. Melvin. All in favor! Motion carries.
Next meeting to be Tuesday, October 20, 2009 at 7:30 PM.
